1. Agreement to Terms

Welcome to CUREA ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the website located at curea.shop (the "Site"), including any purchases, subscriptions, content, functionality, and services offered on or through the Site.

By accessing or using the Site, placing an order, or subscribing to our products, you agree to be bound by these Terms, our Privacy Policy, and our Refund & Cancellation Policy. If you do not agree to these Terms, you must not access or use the Site.

You must be at least 18 years of age to use this Site or make a purchase. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

Skincare Disclaimer: CUREA products are cosmetic skincare products intended for external use only. Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Results may vary. If you have a skin condition, allergies, or concerns, consult a dermatologist before use.

We do not warrant that the quality of any products purchased will meet your expectations or that any errors on the Site will be corrected.

6. Subscription Terms

CUREA operates on a subscription-based model. By subscribing, you agree to the following:

Recurring Billing: When you subscribe, you authorize us to charge your selected payment method on a recurring basis at the billing interval you selected (e.g., every 30, 60, or 90 days) until you cancel.

Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel at least 72 hours before your next billing date.

Price Changes: We reserve the right to change subscription pricing at any time. If we change prices, we will notify you via email at least 7 days before the new price takes effect. Your continued subscription after the price change constitutes acceptance of the new price.

Cancellation: You may cancel your subscription at any time by logging into your account or contacting us at support@curea.shop. Cancellation stops future charges only. No refunds will be issued for orders already processed or shipped.

Failed Payments: If your payment method is declined, we may attempt to charge it again. If payment continues to fail, your subscription may be paused or cancelled, and we may suspend your access to subscriber benefits.

7. Pricing and Payment

All prices are displayed in USD unless otherwise indicated and are subject to change without notice.

Payment Methods: We accept major credit cards, debit cards, and other payment methods as displayed at checkout. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

Billing Errors: If we believe a transaction may be fraudulent, unauthorized, or erroneous, we reserve the right to cancel or reverse the transaction and suspend your account pending investigation.

Taxes: You are responsible for any applicable sales tax, VAT, or other taxes associated with your purchase, unless otherwise stated.

8. Shipping and Delivery

We currently ship to addresses within the United States and select international destinations. Shipping times and costs are estimated and not guaranteed.

Shipping Times: Estimated delivery times are provided at checkout and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other factors outside our control.

Shipping Address: You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by you.

Lost or Stolen Packages: Once a package is marked as delivered by the carrier, we are not responsible for lost or stolen packages. If you believe your package was stolen, please file a claim with the carrier directly.

International Orders: International customers are responsible for any customs duties, taxes, or import fees imposed by their country. We are not responsible for delays due to customs processing.

9. Refund Policy

All sales are final. We do not offer refunds, returns, or exchanges except as outlined in our Refund & Cancellation Policy. Please review the full policy on our Site before making a purchase.

10. Intellectual Property

The Site and its entire contents, features, and functionality—including but not limited to all text, graphics, logos, images, product designs, software, and the compilation thereof—are owned by CUREA, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks: "CUREA," the CUREA logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CUREA. You may not use such marks without our prior written permission.

Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. This license does not include:

  • Any resale or commercial use of the Site or its contents
  • Any collection or use of product listings, descriptions, or prices
  • Any derivative use of the Site or its contents
  • Any downloading or copying of account information for the benefit of another party
  • Any use of data mining, robots, or similar data gathering tools

Any unauthorized use terminates the license granted herein.

11. User-Generated Content

By submitting reviews, testimonials, photos, or other content to the Site ("User Content"), you grant CUREA a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

You represent and warrant that:

  • You own or control all rights to the User Content
  • The User Content is accurate and not misleading
  • The User Content does not violate these Terms or any applicable law
  • The User Content will not cause injury to any person or entity

We reserve the right to remove any User Content at our sole discretion without notice.

The Site may contain links to third-party websites or services that are not owned or controlled by CUREA. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that CUREA shall not be responsible or liable for any damage or loss caused by or in connection with the use of any third-party websites or services.

13. Disclaimers

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, CUREA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

CUREA DOES NOT WARRANT THAT:

  • THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • THE RESULTS FROM USING OUR PRODUCTS WILL MEET YOUR EXPECTATIONS
  • ANY ERRORS ON THE SITE WILL BE CORRECTED
  • THE SITE OR SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS

YOU USE THE SITE AND PURCHASE PRODUCTS AT YOUR OWN RISK.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CUREA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, REVENUE, OR DATA
  • PERSONAL INJURY OR PROPERTY DAMAGE
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE
  • ANY DAMAGES ARISING FROM PRODUCTS PURCHASED THROUGH THE SITE
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO CUREA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to defend, indemnify, and hold harmless CUREA and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Site
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit to the Site
  • Any fraudulent or illegal activity

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law provisions.

17. Dispute Resolution

Informal Resolution: Before filing any claim, you agree to first contact us at support@curea.shop and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.

Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

20. Entire Agreement

These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and CUREA regarding the Site and supersede all prior agreements, understandings, and communications.

21. VIP Club

If you purchase any product labeled, described, or marketed as a “VIP Club,” “VIP Membership,” “VIP Access,” or similar recurring membership product (the “VIP Club”), you acknowledge and agree that you are enrolling in a monthly recurring membership program.

By completing a VIP Club purchase, you expressly authorize CUREA to automatically charge your selected payment method on a monthly recurring basis at the price and billing interval disclosed at checkout, until you cancel the membership in accordance with these Terms.

The VIP Club may include, without limitation, subscriber-only pricing, exclusive access to products or content, priority fulfillment, special offers, or other benefits as described on the Site at the time of purchase. Benefits may change at our discretion.

Your VIP Club membership will automatically renew each month unless canceled at least 72 hours before your next billing date. Cancellation stops future charges only. No refunds will be issued for membership fees already charged, including partially used billing periods.
